# Construction OTAs:Are New Opportunities Emerging for the AEC Industry?

![Picture of Archisha Mehan](https://fedconsult.com/hs-fs/hubfs/Archisha%20head%20shot.jpeg?width=50&name=Archisha%20head%20shot.jpeg) By   Archisha Mehan  ·   5 minute read

If you are in the Construction and Design Build industry, are you tracking Other Transaction Agreements (OTAs)? While the federal government, specifically the Department of Defense has been using OTAs to procure innovative solutions, their use in construction have been limited.

One award that brought construction OTAs to my attention was the award of W51EW7269A001, a production OTA awarded to ICON Technology Inc. for soldier accommodations at Fort Polk, Louisiana, according to Tango on March 6, 2026, with a YTD obligated amount of $67.8M and a reported value of $201M. The project uses 3D-printing technology to deliver soldier accommodations and supporting facilities.

However, the [2026 National Defense Authorization Act](https://www.congress.gov/bill/119th-congress/senate-bill/1071/text) (NDAA) expanded the opportunity for OTAs within the AEC industry through the addition of [10 U.S.C. 2808a,](https://www.hklaw.com/en/insights/publications/2026/07/the-new-ota-authority-for-military-construction) This provision gives authority to the military to “enter into transactions (other than contracts, cooperative agreements, or grants) to carry out repair and construction projects for facilities, including the planning, design, engineering, prototyping, piloting, and execution of such repair and construction projects”.

This is significant as it provides an additional authority for facility construction and repairs, beyond the use of prototype OTAs for innovative construction technologies.

I have been tracking the OTs under this authority and thought it would be interesting to see the open opportunities as of October 21, 2026 under Section 2808a.

*Note: The AMIP-CSO is included as Revision 2 cites §2808a*

The 19 opportunities listed above are across the Army, Air Force, Navy, Marine Corps and Space Force, with the US Army Corps of Engineers (USACE) doing the majority of the contracting. The project scope includes work on barracks, child development centers, laboratories, hangars, airfield repairs, and utility systems.

## What the data tells us

Looking across these projects, a few patterns stand out.

- The dollars are real. Only 10 of the 21 projects list a value, and those 10 alone add up to roughly $1.15B–1.22B.
- USACE is running 17 of the 21 projects, often on behalf of the Air Force, Space Force and Marine Corps. USACE Fort Worth District alone has five.
- Progressive Design-Build is the method of choice. At least seven projects name PDB as the planned or leading approach.
- Most of these are at the market research, RFI, sources-sought or industry-day stage. Only five have a formal submission due, such as a white paper, solution brief or qualifications package. That means there is still time to influence how these requirements are written.

*Projects to follow*

The Space Force's [September 14 construction industry-day notice](https://sam.gov/opp/af24ab6b213b4b899c3101c7db1b3549/view) (not included above) also provides context. It invited industry to discuss commercial construction practices and described OTAs as an additional delivery tool alongside existing approaches, including Multiple Award Construction Contracts.

The [RAPID program at Robins AFB](https://sam.gov/opp/4ee58f239e944fa8975c6cf019f365a7/view) seeks to completely modernize base infrastructure and execute facility repair and construction projects using OTAs. It works as an umbrella program that allows the Air Force to publish project-specific solicitations, referred to as Areas of Interest (AOIs), directly under this umbrella.

## What does this mean for construction and design-build companies?

Educate yourself: Understand what Other Transactions are, specifically within your industry, how they differ from FAR-based contracts, and how agencies can use them. Attend webinars and trainings to become familiar with them.

Engage with the agencies: Both the agencies and industries are learning how to use these agreements. In fact, many of these notices ask industry to help the government assess delivery methods, commercial practices, pricing, scheduling, and risk. Use these opportunities to explain what your company can deliver and how you would approach the requirement.

Ensure you have the right team: Construction projects often require capabilities across multiple disciplines, including design, engineering, construction, technology, and project management. Evaluate whether your company has the relevant experience or needs to team with others.

Evaluate your capabilities and response materials: Many OT opportunities begin with a white paper, solution brief, or capability submission rather than a traditional proposal. Review what the agency is asking for and ensure your response addresses the specific requirement, including your proposed approach and any innovative solutions you can offer.

Set up the right searches: Do not rely solely on NAICS codes when tracking OT opportunities, as these are not always included in the notices. Search for terms such as *Other Transaction, OTA, Section 2808a, Progressive Design-Build,* and *Areas of Interest*, along with the relevant agencies and buying offices.

## Looking Ahead to FY27

The use of OTAs for construction is still evolving, and it remains to be seen how extensively agencies will use this new authority. However, the number and range of projects being explored suggest that this is an area the AEC industry should be watching closely.

For construction and design-build companies, the opportunity is not simply about finding another solicitation. It is about understanding how agencies are changing their acquisition approaches, engaging with them early, and positioning your company for projects that may be procured differently from traditional FAR-based contracts.

As you develop your FY27 business development and capture strategies, I would encourage you to look beyond your traditional NAICS-based opportunity searches. Track the agencies exploring these authorities, understand their requirements, and pay attention to the industry engagement opportunities.

**The question is not just whether construction OTAs will grow, but whether your company is prepared to compete if they do.**
